Sarwendah Absent, Attorney Advised Her to Skip
The first hearing of the breach-of-contract lawsuit filed by Sarwendah against Ruben Onsu was held at the South Jakarta District Court on Tuesday (October 13, 2026). Sarwendah did not attend the hearing, and her attorney, Jaenudin, explained the reason.
According to Jaenudin, Sarwendah's absence was his call as her attorney. He advised his client not to attend because the first hearing's agenda was merely to verify the parties' completeness, including each side's legal standing examined by the panel of judges. "Today is the first hearing agenda. Sarwendah is indeed not present. I advised her not to attend because the first hearing is only about the parties' completeness," Jaenudin said.
Deed 39 and the Disputed House Installments
Jaenudin confirmed the case is a breach-of-contract lawsuit concerning Deed 39, whose implementation is deemed to have stalled. Differing interpretations are at the heart of the dispute: Ruben's side argues the house installments in the deed should be paid jointly, while Sarwendah's side is suing to have the court test the parties' interpretations.
"Because of that multi-interpretation, the breach-of-contract lawsuit is very much needed to test the parties' interpretations. Whether it is indeed paid together or is RO's (Ruben Onsu's) obligation regarding the settlement," Jaenudin explained. Until a legally binding court ruling, both sides remain entitled to the presumption of innocence.
BDN and Rempoa Assets, Rp12 Billion Obligation
Jaenudin also clarified that the lawsuit only concerns assets still pledged to the bank. He named two assets: houses in the BDN and Rempoa areas, pledged to BCA bank.
On the nominal amount, Jaenudin said the total obligation reaches around Rp12 billion (roughly USD 730,000) based on the latest check. The figure comes from credit agreements for the two houses, with monthly installments of nearly Rp270 million across three credit agreements.
Next Hearing Moves to Mediation Stage
If the parties' completeness is fulfilled, the next hearing will enter the mediation stage. Sarwendah's presence will only be required at that point. "If today all parties are present, it means all completeness is fulfilled, so the next hearing concerns mediation. Perhaps at mediation, Sarwendah will attend," Jaenudin said.
Sarwendah is suing Ruben Onsu in a civil case over alleged breach of contract at the South Jakarta District Court. The lawsuit is registered as case number 1198/Pdt.G/2026/PN JKT.SEL, filed on September 28, 2026.
